1. Agreement
By accessing or using ChatWind (“Service”), you agree to these Terms & Conditions (“Terms”). If you do not agree, do not use the Service. ChatWind is operated by RAHISH (“we”, “us”, “our”).
2. The Service
ChatWind provides software to create, configure, and deploy AI agents for chat, voice, and sales across connected channels. Features, limits, and availability may change as the product evolves. We may offer free, paid, and enterprise tiers with different usage limits as described on our pricing page.
3. Accounts
You must provide accurate registration information and keep your credentials secure. You are responsible for all activity under your account. You must be at least 18 years old or have legal authority to bind your organization.
4. Billing
All billing for ChatWind is processed in the name of RAHISH. Paid plans renew according to the billing cycle you select unless cancelled. Fees are non-refundable except where required by law. We may change pricing with reasonable notice; continued use after changes constitutes acceptance.
5. Acceptable use
You agree not to use ChatWind to:
- Violate any law or third-party rights
- Generate spam, malware, or deceptive content
- Attempt to reverse engineer, scrape, or overload the Service
- Process sensitive data without appropriate legal basis and safeguards
- Misrepresent AI-generated responses as human when disclosure is legally required
6. Your content
You retain ownership of content you upload or connect (“Customer Content”). You grant us a limited license to host, process, and display Customer Content solely to provide and improve the Service. You are responsible for ensuring you have rights to use all materials used to train your agents.
7. AI outputs
AI-generated responses may be inaccurate or incomplete. You are responsible for reviewing agent behavior before production use and for configuring appropriate disclaimers, escalation, and human oversight. The Service is provided as a tool; we do not guarantee specific business outcomes.
8. Intellectual property
ChatWind, its branding, software, and documentation are owned by RAHISH and protected by applicable intellectual property laws. These Terms do not grant you ownership of our platform or trademarks.
9. Third-party services
Integrations with WordPress, Shopify, messaging platforms, and other third parties are subject to their own terms. We are not responsible for third-party outages or policy changes.
10. Disclaimer
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
11. Limitation of liability
To the maximum extent permitted by law, RAHISH shall not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill. Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
12. Termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or if required for security or legal reasons. Upon termination, your right to use the Service ends; provisions that by nature should survive will remain in effect.
13. Changes
We may update these Terms from time to time. Material changes will be posted on this page with an updated date. Continued use after changes constitutes acceptance.
14. Governing law
These Terms are governed by applicable local laws where RAHISH operates, without regard to conflict-of-law principles. Disputes shall be resolved in competent courts of that jurisdiction unless otherwise required by mandatory consumer protection laws.
